Terms of Service

PreAppliCheck (“we”, “us”, or “our”) is a division of True Lie Detectors & Vetting (Pty) Ltd (Registration Number: 2023/571462/07), a company registered in South Africa. Our registered address is Office 3, First Floor, Right Side Wing, Refined Park, 11 Inanda Rd, Hillcrest, Durban, 3610.

These Terms of Service (“Terms”) govern your access to and use of the PreAppliCheck website, online platform, and background screening services (collectively, the “Services”). By accessing our website, creating an account, placing an order, or using any of our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Description of Services

PreAppliCheck provides online background screening and pre-employment vetting services in South Africa. We offer two main pathways:

• Individual / Self-Service Pathway: Individuals can select and purchase screening packages directly through our website for personal use (e.g. to attach to job applications).
• Business / Corporate Pathway: Companies, recruiters, and organisations can contact us to set up Service Level Agreements (SLAs) and custom pricing for bulk or ongoing screening requirements.

Our Services include identity verification, criminal record checks, credit checks, qualification verification, employment history checks, and other vetting services as selected by you.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts under South African law to use our Services. By using the Services, you confirm that you meet these requirements.

3. Account Registration

To place orders or access reports, you may need to create an account. You are responsible for keeping your login details secure and for all activity under your account. You must provide accurate and complete information.

4. Placing Orders & Payments (Individual Pathway)

• All prices are displayed in South African Rand (ZAR) and include VAT where applicable.
• Payment is processed securely through our payment gateway (Stripe or similar authorised provider).
• By placing an order, you authorise us to charge the total amount shown at checkout.
• Orders are only confirmed once payment is successfully received and you (or the candidate) have provided the required POPIA consent.

5. Candidate Consent & POPIA Compliance (Critical)

All background screening requires explicit, informed consent from the data subject (the person being screened) in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

• You warrant that you have obtained (or will obtain) valid POPIA consent from every candidate before we begin processing.
• We will not commence any screening without the candidate’s signed or electronically accepted consent.
• You are responsible for ensuring the consent form clearly explains the purpose, types of checks, and who will receive the report.
• We act as both a Responsible Party and an Operator under POPIA depending on the context. Full details are in our Privacy Policy.

6. Delivery of Reports & Turnaround Times

• Standard turnaround times are estimates only and may vary depending on the checks selected and third-party response times.
• Reports are delivered electronically via our secure client portal or email (encrypted where appropriate).
• You are responsible for downloading and storing reports securely. We recommend deleting reports once the purpose has been fulfilled, in line with POPIA retention principles.

7. Accuracy of Information & Disclaimers

Important Notice:

• PreAppliCheck obtains information from third-party sources including credit bureaus, the South African Police Service (SAPS), educational institutions, previous employers, and other verification providers.
• While we take reasonable steps to ensure accuracy, we do not guarantee that all information is complete, accurate, or up to date.
• Criminal record checks are limited to records available through authorised channels at the time of the search.
• You acknowledge that background screening is an aid to decision-making and should not be the sole basis for any employment or other decision.
• We accept no liability for decisions made based on our reports.

8. Use of Reports & Confidentiality

• Reports are provided solely for the purpose stated in the consent form and your order.
• You may not share, publish, or use reports for any other purpose without the candidate’s further consent.
• You must store reports securely and delete them when no longer needed.
• We treat all screening data and reports as strictly confidential.

9. Refunds & Cancellations

• Due to the nature of background screening services (which often commence immediately after consent and payment), refunds are generally not available once an order has been processed.
• If you cancel before we begin work and before consent is obtained, we may, at our discretion, offer a full or partial refund (less any reasonable administrative fee).
• Requests for refunds must be submitted in writing to admin@tldv.co.za within 7 days of the order.

10. Prohibited Uses

You may not use our Services to:

• Conduct screening without valid POPIA consent
• Harass, discriminate against, or unlawfully disadvantage any person
• Submit false or misleading information
• Reverse engineer, scrape, or interfere with our platform
• Use reports for any illegal purpose

11. Intellectual Property

All content on the PreAppliCheck website, including logos, text, graphics, and the PreAppliCheck brand, is owned by or licensed to True Lie Detectors & Vetting (Pty) Ltd. Reports generated for you remain your property for the permitted use, subject to these Terms.

12. Limitation of Liability & Indemnity

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or reliance on reports.
• Our total liability for any claim shall not exceed the total fees paid by you for the specific order giving rise to the claim.
• You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your breach of these Terms, misuse of reports, or failure to obtain proper consent.

13. Termination

We may suspend or terminate your access to the Services at any time if you breach these Terms or for any other reasonable reason. Upon termination, your right to use the Services ends immediately.

14. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on our website with the effective date clearly shown. Continued use of the Services after changes constitutes acceptance of the updated Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa (with preference for the Durban High Court or Magistrates’ Court having jurisdiction).
